Sydney holiday rentals: the 180-day cap, strata, and a year that is not only New Year’s Eve

General information, not legal, tax or insurance advice. Check your own case with your council, the ATO or the state revenue office, or an accountant. Rates and dates below were checked on the date shown — recheck the linked official page before you lodge, register or set a price from them.

Non-hosted short-term rentals in Greater Sydney are limited to 180 days in each registration year. The Central Coast is outside that list. Hosted stays are not capped. Stays of 21 nights or more do not use the cap. A strata scheme can ban the use where the lot is not your home.

Sydney is a capped market that still gets talked about as if it were a beach town with a festival attached. New Year’s Eve, the Mardi Gras weekend and Vivid fill photos. They do not fill 180 nights, and 180 is the number a non-hosted dwelling in Greater Sydney actually has. The skill is deciding which nights deserve the cap, and which building will let you sell them at all.

The cap is a budget, not a backdrop

The rule itself — who is in Greater Sydney, the Central Coast exclusion, the 21-night exception, the registration clock — is written up in the NSW register guide. What it means on the ground is a choice. A Northern Beaches house that takes every summer week, the Easter long weekend and a scatter of winter Saturdays will hit the cap in the months guests will pay, and sit dark in the weeks they will not. That can be the right business. It is a bad surprise if you discover it in October because Airbnb, Stayz and two direct regulars were never added together.

A 21-night stay for a locum, a production or a relocating employee does not consume the cap. Inner-city and suburban apartments that can take a luggage drop and a quiet week are built for that guest. A party listing is not. Write the minimum stay and the house rules so the 21-night guest is who you attract, and track that stay separately in your own head: it is revenue, and it is not one of the 180. Pricing the two products differently is covered in holiday rental pricing.

The building can end the plan

Section 137A is the Sydney conversation that outranks the cap. If the lot is not your principal place of residence, the owners corporation can prohibit short-term letting by special resolution. If it is your home, they cannot. Investment stock in buildings that have passed the by-law is not a short-stay asset, however attractive the view. The mechanics are in strata by-laws. Assume a high-rise will also enforce two adults a bedroom, the car-park plan, and a smoking ban. Put those in check-in. A guest who learns them from a security guard is a review.

The year, without pretending we have a crystal ball

Summer, from the Christmas week through the Australia Day long weekend, is the peak on the coast and still strong in the eastern suburbs. School-holiday dates differ by state, which matters because a Queensland family and a Victorian family do not arrive in the same week — see school holidays. Vivid is usually late autumn into winter and pulls a different guest from a beach week. Long weekends and one-off events move; check Destination NSW rather than locking a rate card to last year’s poster. The summer operating problems — minimum nights, linen, cancellations — are in the Christmas peak.

International guests still come through Booking.com and Airbnb. Australian families still come through Stayz, especially for whole homes. The fee you pay on each of those is not the same, and a capped night sold on the expensive channel is a night you do not get back. Compare them in host fees before you decide the 180.

Recheck the LGA and the by-laws. The 180-day geography was read from NSW Planning’s FAQ on 22 October 2026. Your council’s name, your registration date and the registered strata by-law are the three documents that decide this property. Event dates belong to Destination NSW, not to a blog.

Frequently asked questions

Does the 180-day cap cover all of Sydney?

It covers non-hosted STRA in the Greater Sydney councils listed by NSW Planning, and the FAQ says that region does not include the Central Coast. Hosted stays are uncapped. A valid development consent can sit outside the exempt-pathway cap, subject to whatever the consent itself says. The council-by-council list is in the NSW guide — do not guess from a suburb name.

When does the Sydney year reset?

On the anniversary of registration, not on 1 January. A property registered in August does not get a fresh 180 nights because the calendar flipped.

Can I let a Sydney investment unit?

Only if planning allows it and the owners corporation has not used section 137A to prohibit short-term rental accommodation in lots that are not the host’s home. An owner-occupier is protected. An investor is not. Read the by-laws before you furnish the place.

What sells outside school holidays?

Midweek corporate and medical stays, productions, and anyone in town for more than three weeks. Those 21-night-plus bookings are excluded from the cap, which is why a CBD or inner-west apartment that only chases Friday–Sunday leisure is leaving the useful nights on the table. Weekend beach stock — Northern Beaches, the eastern suburbs — lives and dies on summer, long weekends and the school holidays.
